Welcome to 1HourStore, a service operated by Emergenttrades, LLC ("Company", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of the 1HourStore platform, including our website, software, and services (collectively, the "Service").

By creating an account, accessing, or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our Service.

1. Account Registration and Eligibility

1.1 Eligibility

You must be at least 18 years old and capable of entering into legally binding contracts to use our Service. By registering for an account, you represent and warrant that you meet these requirements.

1.2 Account Information

You agree to provide accurate, current, and complete information during registration and to update such information as necessary to maintain its accuracy. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

1.3 Account Security

You must notify us immediately of any unauthorized access to or use of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

2. Service Description and Subscription

2.1 Service Overview

1HourStore provides a software-as-a-service (SaaS) platform that enables users to create, manage, and operate online stores. Each subscription includes access to store management tools, hosting, and related services.

2.2 Subscription Plans

Our Service is offered on a subscription basis at $29.90 per month (or alternative pricing for cryptocurrency payments). Payment is due at the beginning of each billing cycle. All fees are non-refundable except as required by law or as explicitly stated in our refund policy.

2.3 Free Trial and Money-Back Guarantee

New customers may be eligible for a 30-day money-back guarantee. To request a refund within this period, you must contact us at support@1hourstore.com. After 30 days, all payments are final and non-refundable.

2.4 Payment Processing

Payments are processed through Stripe, Inc., a third-party payment processor. By providing payment information, you authorize us to charge the applicable fees to your payment method. You are responsible for all charges incurred under your account.

3. Acceptable Use and Prohibited Activities

3.1 PROHIBITED PRODUCTS AND SERVICES

You may NOT use 1HourStore to sell or promote the following items:

Illegal Items: Any products or services that are illegal under federal, state, or local laws, including but not limited to:
- Illegal drugs, controlled substances, or drug paraphernalia
- Stolen goods or items obtained through illegal means
- Counterfeit or pirated products
- Unlicensed firearms, ammunition, or weapons
Regulated Items Without Proper Licensing:
- Tobacco products (unless you possess all required federal and state licenses)
- Alcoholic beverages (unless you possess all required federal and state licenses)
- Cannabis or CBD products (subject to federal and state regulations)
- Prescription medications or controlled pharmaceuticals
- Medical devices requiring FDA approval
Dangerous or Hazardous Materials:
- Explosives, fireworks, or incendiary devices
- Hazardous chemicals or biological materials
- Radioactive materials
Adult Content and Services:
- Pornographic or sexually explicit material
- Escort services or prostitution
- Any content involving minors in a sexual or suggestive manner
Fraudulent or Deceptive Products:
- Pyramid schemes or multi-level marketing schemes
- Get-rich-quick schemes or deceptive business opportunities
- Products making false or misleading health claims
- Fake documents (IDs, diplomas, certificates)
Intellectual Property Violations:
- Counterfeit designer goods or trademarked items
- Unauthorized copies of copyrighted material (software, media, books)
- Products infringing on patents, trademarks, or copyrights
Harmful or Offensive Content:
- Products promoting hate, violence, or discrimination
- Items glorifying terrorism or criminal activity
- Content intended to harass, threaten, or bully individuals
Wildlife and Endangered Species:
- Products made from endangered or protected animals
- Illegal animal products (ivory, certain furs, exotic pets)
Financial Services Requiring Licensing:
- Unlicensed investment advice or securities
- Cryptocurrency mining services (without proper disclosures)
- Unlicensed insurance products

IMPORTANT: If your business sells regulated products (such as tobacco, alcohol, or CBD), you MUST provide proof of all required federal, state, and local licenses before your store will be approved for operation. Failure to maintain proper licensing may result in immediate suspension or termination of your account.

3.2 General Prohibited Conduct

You agree NOT to:

Use the Service for any unlawful purpose or in violation of any applicable laws
Interfere with or disrupt the Service or servers/networks connected to the Service
Attempt to gain unauthorized access to any portion of the Service or any systems or networks
Upload or transmit viruses, malware, or any other malicious code
Engage in any automated use of the system (bots, scrapers, spiders)
Impersonate any person or entity or falsely state or misrepresent your affiliation
Collect or harvest any information from other users
Use the Service to send spam, phishing attempts, or unsolicited communications

3.3 Compliance with Laws

You are solely responsible for ensuring that your use of the Service and the products you sell comply with all applicable federal, state, and local laws and regulations. This includes, but is not limited to, consumer protection laws, tax laws, export control laws, and industry-specific regulations.

4. Content and Intellectual Property

4.1 Your Content

You retain ownership of all content you upload to the Service, including product descriptions, images, and other materials ("Your Content"). By uploading Your Content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, display, and transmit Your Content solely for the purpose of providing the Service to you.

4.2 Content Responsibility

You are solely responsible for Your Content and the consequences of posting or publishing it. You represent and warrant that you own or have the necessary rights to use and authorize us to use Your Content as described in these Terms.

4.3 Our Intellectual Property

The Service, including its software, features, functionality, and branding, is owned by Emergenttrades, LLC and is protected by copyright, trademark, patent, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our express written permission.

5. Store Management and Transactions

5.1 Store Ownership and Control

You maintain full control over your store's content, pricing, and operations. We provide the platform and tools, but you are responsible for managing your store, fulfilling orders, and providing customer service to your customers.

5.2 Payment Processing

We integrate with Stripe for payment processing. You are subject to Stripe's Terms of Service when processing customer payments. We are not responsible for payment processing errors, disputes, or issues arising from Stripe's services.

5.3 Taxes

You are responsible for determining and collecting applicable sales taxes for products sold through your store. We provide tools to help manage sales tax, but you are solely responsible for tax compliance.

5.4 Customer Disputes

You are responsible for handling disputes with your customers, including refunds, returns, and chargebacks. We are not a party to transactions between you and your customers.

6. Term, Termination, and Suspension

6.1 Term

These Terms remain in effect for as long as you use the Service or maintain an account.

6.2 Termination by You

You may cancel your subscription at any time through your account settings or by contacting us. Upon cancellation, you will retain access to your account until the end of your current billing period.

6.3 Termination or Suspension by Us

We reserve the right to suspend or terminate your account immediately, without prior notice or liability, if:

You breach these Terms, including selling prohibited items
Your account is involved in fraudulent or illegal activity
We are required to do so by law
Your payment fails or your account is past due
We determine, in our sole discretion, that your use of the Service poses a risk to us, other users, or third parties

6.4 Effect of Termination

Upon termination, your right to use the Service ceases immediately. We will provide you with a reasonable opportunity to export your store data, but we are not obligated to retain your data after termination.

7. Disclaimers and Limitations of Liability

7.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

7.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EMERGENTTRADES, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Your use or inability to use the Service
Any unauthorized access to or use of our servers and/or any personal information stored therein
Any interruption or cessation of transmission to or from the Service
Any bugs, viruses, or the like that may be transmitted through the Service by any third party
Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

7.3 Third-Party Services

The Service may integrate with third-party services (such as Stripe, SendGrid, or Facebook). We are not responsible for the operation, availability, or security of these third-party services. Your use of third-party services is subject to their respective terms and conditions.

8. Indemnification

You agree to indemnify, defend, and hold harmless Emergenttrades, LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

Your violation of these Terms
Your use of the Service
Your Content or products sold through your store
Your violation of any rights of another party, including intellectual property rights
Any claim that Your Content caused damage to a third party

9. Privacy and Data Protection

Our collection and use of personal information is described in our Privacy Policy. By using the Service, you consent to our collection and use of personal information as outlined in the Privacy Policy.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through a notice on the Service. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service.

11. Governing Law and Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions.

11.2 Dispute Resolution

Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, with the arbitration to take place in Wyoming. You waive your right to participate in a class action lawsuit or class-wide arbitration.

12. General Provisions

12.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Emergenttrades, LLC regarding the Service and supersede all prior agreements and understandings.

12.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

12.3 Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

12.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign or transfer these Terms without restriction.
